Many Paleo-cons and statists of all stripes trumpet the “rule of law”.  Within reason and sense the rule of law is good and important.  The problem in the U.S. as illustrated in a small example set is that we suffer from the rule of lawyers much more than any rule of law.

An observations such as; “Under the English common law we inherited, a crime requires intent. This protection is disappearing in the U.S.” should be frightening to Americans who value the liberties of the citizenry.  An old saw is that the only problem with legislators is they are constantly making more laws.

Rule of law should first protect the liberties of the citizenry.
