For different reasons..Constitutional War making powers

April 21, 2009 – 2:54 pm

While I think the motivation of these people may be different than my own, I agree with this challenge.

Was the Iraq War Constitutionally authorized?  Was it within the powers of the Executive without an explicit declaration of War?

Many of these same questions can be asked regarding the ongoing “war” on extremist, fascist terrorists who are Stateless.

This is worthy of debate.

  2. Congress declares war. The Executive, and all subordinates in the Executive Branch, down to the Corporal level, can respond, on their own initiative, to attacks upon the homeland or upon our forces. (See FORSCOM Reg. 500-3-3, for example, for specific language authorizing Reserve Component commanders to repel attacks on their own initiative.)
Saddam had no WMD (he needed some, in that neighborhood). He did not attack us. Bush ’43s actions were un,lawful, and the Congress, with only a few exceptions, is populated by cowards who were derelict in their duty to rein him in. The war was/is illegal, and it’s a blot on our name that no one has been fired or prosecuted for the illegal execution of a war based on a lie.
