Exclusionary Erosion
February 1, 2009 – 6:34 amRadley Balko points out something very few probably consider, the erosion of our 4th amendment rights (the exclusionary rule).
The leftists on the SCOTUS get a lot of attention for their disregard of the Constitution. You should look at all the justices though. It is a matter of pick and choose for them regardless of seeming social/political/cultural stance.
Eroding our rights in the name of “law and order” is just as dangerous as treating our Constitution as a “living” document as liberals wish to do.
Keep an eye on Scalia and Thomas at least in this regard. Being free is more important than an egg head’s idea of you being “safe”.
One Response to “Exclusionary Erosion”
Excellent point. The liberals tend to assail property rights (Kelo, for example, on eminent domain), while conservatives tend to downplay civil rights – real civil rights, as in those spelled out in the Constitution, and those inherent ‘rights of Englishmen’ that are ours in Common Law, and which the 9th Amendment explicitly recognizes. Conservative justices give away the store on the 4th Amendment, in the name of ‘law and order’ all too often. For example: As much as I disliked how Robert Bork was treated in his confirmation hearings, his denial of any right to privacy would have been enough for me to have voted against him.
