If it is a “War”, Declare it

Reading Ann Coulter is always a hoot. She asks the question today of whether the military or the courts should “run the war”.

That question would be slam dunk easy if the “war” we are fighting fit within the Constitutional definition of a “war”. In other words, was declared by Congress as specified in section 8.

As long as we are engaged in an extra-constitutional “war”, the courts are acting within their capacity. A capacity that can be, Constitutionally, specifically delineated by Congress.

So while Ann is making a point about the silliness of extending rights of U.S. citizenry under law to Islamic radical terrorist foreigners, her premise from which to argue is flawed.

If you want a “war”, then DECLARE as war.
